Will DMTN Daniel Receive Favorable Treatment in His Drug Case?




The arrest of DMTN member Daniel has sparked a debate among netizens and law officials alike on whether he will be able to receive favorable treatment.

Some have stepped forth to point out that since Daniel gained nothing from his actions and wasn′t aware that he was getting himself involved in a criminal act, he should receive favorable treatment in that aspect.
One official stated, "Acting as a middle-man for marijuana smokers definitely counts as a crime. Even if he didn′t know it was against the law, that doesn′t make his crime any lesser."

Another official told enews, however, that "it is true that he has committed a crime, but he has lived abroad for a long time, did not have a clear purpose or intention, and did not earn any monetary profit from the act. There is room for favorable treatment."

According to the fourth clause of Article 61 in drug law, those who smoke marijuana are subject to at most five years in jail or a fine less than 50 million won. Those who sell or get involved in the sale of the drug, however, fall under the seventh clause of Article 59, which states offenders are subject to at least a year in prison.

Daniel was first questioned on the charges on March 9.
